01 Acceptance of Terms
By accessing or using Afrodigitalz.com (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to any part of these Terms, you must immediately discontinue use of the Platform. These Terms apply to all visitors, registered users, vendors, and API users of the Platform.
02 Eligibility
To use Afrodigitalz.com, you must:
- Be at least 18 years of age
- Be a resident of or located in the Federal Republic of Nigeria
- Have the legal capacity to enter into a binding contract
- Not have been previously banned or suspended from our platform
- Provide accurate and truthful registration information
By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.
03 Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete registration information
- Keep your password secure and not share it with any third party
- Notify us immediately of any unauthorized access or suspected breach at theafrodigitalz@gmail.com
- Not create more than one account per person without written permission
- Not transfer your account to another person
04 Our Services
Afrodigitalz.com provides a digital services platform including, but not limited to:
- Social Media Marketing (SMM) services
- Virtual/foreign phone number rental
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. Certain services may be unavailable due to network provider downtime, regulatory changes, or maintenance. We are not liable for service interruptions beyond our control.
All services are provided on an "as is" and "as available" basis. Delivery times for third-party services (e.g. data, cable) are subject to the respective network providers and may vary.
05 Wallet & Payments
The Afrodigitalz.com wallet is a stored-value account used to pay for services on the platform.
- Funding: Your wallet can be funded via bank transfer to your dedicated virtual account or via supported payment gateways. Minimum funding amount is ₦100.
- Charges: A funding charge (percentage-based) applies to all wallet top-ups. Current rates are displayed at checkout.
- Wallet balance: Your wallet balance does not accrue interest and has no expiry, provided your account remains active.
- Withdrawals: Wallet balances are non-withdrawable to a bank account. Balances may only be used for services on the platform.
- Account closure: On account closure, remaining wallet balance will be reviewed on a case-by-case basis per our refund policy below.
06 Refund Policy
We are committed to fair resolution of service issues:
- Failed transactions: If a service payment is deducted but the service is not delivered, we will investigate and refund your wallet within 24–72 hours.
- Successful deliveries: Refunds are not issued for services already delivered. This includes data delivered to the wrong number entered by the user.
- Disputed transactions: Contact our support team within 7 days of the transaction to raise a dispute. Late disputes may not be honoured.
- Wallet funding: Funding charges are non-refundable. Erroneously funded wallet amounts may be reviewed on a case-by-case basis.
To request a refund or raise a dispute, use the "Report Issue" feature on your transaction detail page or contact theafrodigitalz@gmail.com.
07 Prohibited Conduct
You agree not to use the Platform for any of the following:
- Any fraudulent, deceptive, or illegal activity
- Money laundering or financing of illegal activities
- Reselling our services without our express written consent (except authorized vendors)
- Automated scraping, crawling, or bot-based use of the platform without permission
- Attempting to bypass security, access control, or authentication systems
- Creating fake accounts or using false identity information
- Abusing the dispute or chargeback system
- Sharing your account credentials or allowing third parties to use your account
- Using the platform in any way that could damage, disable, or overburden our infrastructure
- Violating any applicable Nigerian or international law or regulation
Violation of any of the above may result in immediate account suspension, forfeiture of wallet balance, and/or referral to appropriate law enforcement agencies.
08 Intellectual Property
All content, branding, design, software, and materials on the Platform are the exclusive property of Afrodigitalz.com or its licensors and are protected by applicable Nigerian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for its intended purpose. You may not:
- Copy, modify, or distribute any Platform content without written permission
- Reverse engineer or attempt to extract the source code of our software
- Use our branding, logo, or trademarks without prior written consent
09 Limitation of Liability
To the maximum extent permitted by Nigerian law, Afrodigitalz.com and its officers, employees, and affiliates shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, goodwill, or business opportunities
- Service interruptions caused by network providers, regulatory changes, or force majeure events
- Unauthorized access to your account resulting from your own negligence
- Actions of third-party service providers beyond our control
Our total liability to you for any claim shall not exceed the amount paid by you on our platform in the 30 days preceding the claim.
10 Termination
By you: You may close your account at any time by contacting our support team. Closing your account does not automatically entitle you to a refund of wallet balance.
By us: We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if:
- You violate any provision of these Terms
- We are required to do so by law or regulatory authority
- We detect fraudulent, abusive, or suspicious activity on your account
- Your account has been inactive for more than 24 months
On termination, your right to access the Platform ceases immediately. Sections relating to liability, intellectual property, dispute resolution, and governing law survive termination.
11 Dispute Resolution
In the event of a dispute arising from these Terms or your use of the Platform, both parties agree to first attempt resolution through good-faith negotiation.
If a resolution cannot be reached informally within 30 days, the dispute shall be referred to mediation under the Lagos Multi-Door Courthouse (LMDC) or such other agreed body. If mediation fails, the matter may proceed to litigation in the courts of Lagos State, Nigeria.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a competent court.
12 Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to the Nigeria Data Protection Act (NDPA) 2023, the Federal Competition and Consumer Protection Act (FCCPA), and applicable CBN regulations.
13 Changes to Terms
We may update these Terms at any time. When we make material changes, we will:
- Post the updated Terms on this page with a new "Last Updated" date
- Send a notification to your registered email address
- Display a banner on the Platform for at least 7 days
Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Platform.
